Terms and Conditions
Article 1 [Purpose) These terms and conditions are used when using the Internet-related services (hereinafter referred to as “services”) provided by XM Cyber Mall (hereinafter referred to as “mall”) operated by Cascade Tech Co., Ltd. (e-commerce provider). The purpose is to define the rights, obligations and responsibilities of the company. ※ ``This agreement applies to e-commerce using PC communications, wireless, etc., unless contrary to its nature.'' Article 2 (Definition) ① “Mall” is a virtual business place set up by Cascade Tech Co., Ltd. to use the information and communication equipment such as computers to trade goods or services to provide goods or services (hereinafter referred to as “goods”) to users. It is also used as a business operator operating a cyber mall. ② “User” means a member who accesses the “mall” and receives the services provided by the “mall” in accordance with these terms and conditions. ③ “Member” refers to a person who has registered as a member of the “Mall” and can continuously use the services provided by the “Mall”. ④ “Non-member” refers to a person who uses the services provided by the “Mall” without registering for membership. However, this is not the case when the “Mall” proves that there is no intention or negligence. Article 5 (Suspension of Service) ① The “Mall” may temporarily suspend the provision of services in the event of reasons such as maintenance checks, replacements and breakdowns of computers and information and communication facilities, and loss of communication. ② The “Mall” compensates for damages suffered by users or third parties due to the temporary suspension of service provision for the reason of paragraph 1. However, this is not the case when the “Mall” proves that there is no intention or negligence. ③ In the event that the service cannot be provided due to the conversion of business items, abandonment of business, integration between companies, etc., the “Mall” notifies the user in the manner specified in Article 8 and according to the conditions originally set out in the “Mall” Rewards. However, if the “Mall” does not notify the compensation standards, etc., the mileage or reserves of the users are paid to the user in kind or cash corresponding to the currency value used in the “Mall”. Article 6 (member registration) ① The user applies for membership by filling out the member information according to the registration form set by the “Mall” and expressing his intention to agree to these terms. ② “Mall” is registered as a member of the users who applied to join as a member as described in Paragraph 1, unless they fall under any of the following items. 1. If the applicant for membership has previously lost membership under Article 7 (3) of these Terms and Conditions, however, three years have elapsed since the loss of membership under Article 7 (3); An exception is made when. 2. Article 7 (withdrawal of membership and loss of qualification, etc.) ① Members can request the withdrawal at any time to the “Mall”, and the “Mall” immediately processes the withdrawal of the membership. ② If the member falls under any of the following reasons, the “Mall” may restrict and suspend membership. 1. When false information is registered at the time of application 2. In the event that the member's debts related to the payment of goods purchased using the “Mall” or other “Mall” are not paid on a due date 3. In case of threat to the e-commerce order, such as interfering with the use of the "mall" of others or stealing the information 4. In the case of using the “Mall” to violate laws and regulations or to violate public order and morals ③ After the “Mall” restricts or suspends membership, the “Mall” may lose membership if the same act is repeated more than once or the reason is not corrected within 30 days. ④ In the event that the “Mall” loses membership, the membership registration is cancelled. In this case, the member is notified of this, and a period of at least 30 days prior to the cancellation of membership registration is set to give an opportunity to call. Article 8 (Notification to Members) ① When the “Mall” notifies the member, the member can make an email address specified in advance with the “Mall”. ② “Mall” can replace individual notices by posting on the “Mall” bulletin board for more than one week in the case of notice to unspecified members. However, individual notices are given for matters that have a significant impact on the member's transaction. Article 9 (Purchase application) ① The “Mall” user applies for the purchase on the “Mall” by the following or similar method, and the “Mall” must provide each of the following in an easy-to-understand manner when the user applies for the purchase. 1. If it is judged that the acceptance of the other purchase application is significantly impeded by the “mall” technology ② It is assumed that the agreement has been established when the acceptance of the “Mall” reaches the user in the form of an acknowledgment notice in Article 12 (1). ③ The “Mall”'s intention to approve should include information on the user's purchase application confirmation and availability, and the cancellation of the purchase application. Article 11 (Payment method) The payment method for goods or services purchased in the “Mall” can be made using any of the following methods.
